GENERAL CONDITIONS OF SALE

SUBJECT AND PARTIES OF THE CONTRACT

1.1. Maison Magdarél’s general conditions of sale (“Distance Selling Contract” or “General Conditions”) apply to all sales of Maison Magdarél products (“Products” or “Product”) through the website www.magdarel.com.

PRODUCTS SUBJECT TO THE CONTRACT

2.1. Information on Products (along with the relevant Product codes) and relevant prices are available on the website. Pictures of the Products displayed on the website may not correspond to their actual appearance; the Client shall therefore rely exclusively on the description of the Products and their characteristics as mentioned on the website.

2.2. In no case shall Maison Magdarél be liable for errors occurring due to failure of the Client’s connection to the website.

PRICE

3.1. Ürünlerin fiyatları internet sitesinde Euro cinsinden belirtilmiş olup, tüm geçerli vergi ve harçlar dâhildir. Teslimat masrafları varsa, Ürünlerin fiyatına eklenir.

EXECUTION OF THE CONTRACT

4.1. Before submitting an order through the website, the Client shall read carefully all the instructions provided during the purchase procedure (also regarding possible delivery charges, the right of withdrawal conditions, and the privacy policy statement), along with these General Conditions.

4.2. To purchase the Products, the Client must (i) include the selected Products in the “Shopping Bag” by clicking on the relevant button, (ii) fill in the order document, (iii) select the payment method, (iv) accept the General Conditions, and (v) send the order proposal to Maison Magdarél through the website.

4.3. Once the Order Confirmation is sent to the Client, the order cannot be canceled or modified. Dispatched Products can, however, be returned as set out in Section 7 below.

4.4. The risk of loss of or damage to the Products shall pass to the Client when the Client (or a third party indicated by the Client and other than the carrier) has acquired physical possession of the Products.

PAYMENT METHOD

5.1. Payment for the price of the Products included in the order proposal and the relevant delivery charges, if any, shall be made by the Client via credit card or bank transfer.

5.2. Maison Magdarél accepts payments made with the following credit cards: Visa, MasterCard, American Express.

5.3. The transactions will be debited from the Client’s credit card only after: (i) the credit card data has been verified; (ii) the authorization to debit the card has been received from the issuer of the card used by the Client; and (iii) the availability of the Products has been confirmed by Maison Magdarél.

5.4. Maison Magdarél also accepts payments made by bank transfer to the following IBAN code: IT(*). All costs and expenses (including bank charges) associated with the bank transfer shall be borne by the Client. Payment shall be due within and not later than 7 (seven) working days from the date of the Order Confirmation.

5.5. Herhangi bir nedenle, vadesi geldiğinde Müşteri'nin borcunun tahsil edilememesi (veya banka havalesi ile ödenmesi gereken tutarın Maison Magdarél'in banka hesabına ulaşmaması) durumunda, sözleşme yürürlüğe girmeyecek ve sipariş iptal edilecektir.

RETURN PRODUCTS

Please note we will accept returns sent back within 14 days of receipt of your order.

The Products shall be returned in their original condition, unaltered, unused, undamaged, and with original tags and labels attached. Ensure that briefs are tried on over your own lingerie; we will not accept returns on lingerie that has been damaged or worn. We cannot accept returns on opened briefs hygiene pads. In the event of any diminished value of the Products resulting from the handling of the goods by the Client other than what is necessary to establish the nature, characteristics, and functioning of the goods, Maison Magdarél reserves the right to refuse the return of the Products. The Client shall only be liable for any diminished value of the Products resulting from the handling of the goods other than what is necessary to establish the nature, characteristics, and functioning of the goods.

İadeler: If you are waiting for a refund, once our warehouse receives your return, it may take up to 30 business days to process. You will receive an email notification once our warehouse has received the returned item(s), and your refund or store credit will be posted within 30 business days. We cannot facilitate refunds to a third party. You will receive an email once your order has been refunded.

Full-priced merchandise can be returned for a full refund or exchange. Products marked “Sale” cannot be returned. Products marked “Sale” can be returned for exchange only.

Exchanges: We only offer size exchanges on the same product. Where available, replacement products will be dispatched within 14 days. You will receive a tracking number via email once shipped. If your chosen replacement size is not in stock, for alternative items, please place a new order on our website, or alternatively, please get in touch with our dedicated team.

Non-refundable: Please be advised that, unless faulty, we cannot accept returns for opened briefs hygiene pads due to hygiene reasons.

GEÇERLİ HUKUK VE UYUŞMAZLIKLARIN ÇÖZÜMÜ

7.1. This Distance Selling Contract and, therefore, the Contracts executed with the Clients, shall be governed by and construed in accordance with Italian laws (by Italian legislative decree no. 70 of 9 April 2003 on certain aspects related to e-commerce).

7.2. If a dispute arises under this Agreement, any party may take the matter to the Milan court, jurisdiction of the county of Italy.
